As it is desirable to hold in high regard professional conduct and attitudes of all participating parties, as well as commitment to excellence, effective learning shall be fostered in an environment of mutual respect between the teacher and the learner(s).
The teacher and the learner(s) should strive to develop a relationship that is characterized by mutual trust, acceptance, and confidence.
This Agreement serves both as a pledge and reminder to the teacher and the learner(s) that their conduct in fulfilling their mutual obligations is the medium which will perpetuate their professional relationship, the student’s genuine progress and the teacher’s growing reputation.
Guiding principles lie in the teacher’s and the student’s duties, integrity, and respect.
II. SUBJECT OF THE AGREEMENT
THE TEACHER UNDERTAKES TO:
Duty
- Assess the student’s/s’ skills and create a custom-built course for them
- Teach English language to the student(s) using own methods and learning tools
- Advise the student(s) on setting their S.M.A.R.T. goals in terms of improving their skills
- Attend all arranged and agreed on lessons and / or notify immediately all involved parties if unable to attend for whatever reason
- Maintain high professional standards in all interactions with the student(s)
- Provide relevant and timely information early in a course
- Provide timely, focused, accurate and constructive feedback on a regular basis
- Provide thoughtful and timely evaluations at the end of a course
- Be familiar with the responsibilities within the Teacher-Student Agreement
- Utilize appropriate mechanisms to encourage students who experience post-commencement
Integrity
- Display honesty, integrity and compassion
- Solicit feedback from the student(s) regarding their perception of their educational experiences and personal interactions
Respect
- Treat everyone fairly, respectfully and without bias related to age, race, ethnicity, gender, sexual orientation, religion, spiritual or political beliefs, disability or country of origin
- Be prepared and on time
- Recognize and respect everyone’s rights to privacy
THE STUDENT UNDERTAKES TO:
Duty
- Attend all arranged and agreed on lessons and / or notify immediately all involved parties if unable to attend for whatever reason
- Be an active, enthusiastic, curious learner(s) who works to enhance a positive learning environment
- Recognize the responsibility to develop personal learning goals and to participate as an active learner(s)
- Be cooperative at setting own S.M.A.R.T. goals designed to measure progress and improvement
- Demonstrate professional behaviour in all settings
- Recognize that not all learning stems from formal and structured activities
- Provide the teacher with constructive feedback that can be used to improve the educational experience
- Be familiar with the responsibilities within the Teacher-Student Agreement
Integrity
- Recognize personal limitations and seek help whenever it is needed
- Display honesty, integrity and compassion
- Solicit feedback on performance and recognize that criticism is not synonymous with “abuse”
Respect
- Treat everyone fairly, respectfully and without bias related to age, race, ethnicity, gender, sexual orientation, religion, spiritual or political beliefs, disability or country of origin
- Be prepared and on time
- Recognize and respect everyone’s rights to privacy
III. ONLINE LESSONS & HOMEWORK
All lessons are online (unless otherwise agreed) and take place on publicly accessible platforms such as Skype, Google Meets, MS Teams, Zoom.us or similar. The chosen platform to be used for lessons shall be agreed on by all parties before the course / lessons commence.
The course / lessons shall commence on the date agreed by both the student(s) and the teacher and by signing this agreement. Time differences shall be known by all parties and taken into consideration when scheduling lessons. There is no limit as to when and what time the lessons can take place for as long as both parties agree with suggested day and time.
All lessons (45-, 60-, and 90-minute ones) shall begin and finish at agreed on and designated times.
Homework will be assigned within a reasonable time via e-mail after the lesson finishes (on the same day). The student(s) is / are expected to send completed homework via e-mail no later than on the day prior to the next lesson, so that the teacher has enough time to check it and send it marked back to the student before the lesson begins. The student(s) shall prepare questions (if any) regarding the marked homework and ask them at the beginning of the lesson.
IV. FORCE-MAJEURE AND UNFORESEEN SITUATIONS
Everyone experiences unforeseen situations from time to time, whether it is an unusual traffic jam caused by an accident, the Internet Service Provider (ISP) doing maintenance or simply the dropped internet connection, severe weather conditions, or that mischievous and inconsiderate neighbor of yours who starts drilling holes into the walls midway through the lesson. Such situations are beyond one’s control and it is understandable that one cannot either have a lesson on such days or be fully focused on the material being covered during the lesson.
For the above reasons, it is necessary to set some reasonable rules that shall be used as guiding principles for rescheduling or cancelling lessons:
- Inform and be informed! Should either the student or the teacher be unable to attend an upcoming lesson, they need to let all the other involved parties know as soon as possible either by sending an e-mail or a text message. Should the concerned person be unable to elaborate on their reasons for rescheduling / cancelling the lessons at that very moment, they shall still inform the others by sending a short e-mail or text message as follows:
– for cancelling, the student / teacher shall write the capital “X” into the e-mail message subject line or in the text message, whichever they prefer
– for joining the lesson with a slight delay (up to 10 minutes), the student / teacher shall write the capital “L” in into the e-mail message subject line or in the text message, whichever they prefer
If the concerned party has time to elaborate on the reasons why they will not be able to attend the lesson that is set to take place in less than 24 hours, they are encouraged to do so right away. The concerned party can state the reasons afterwords as to why they had to cancel the lesson; however, they shall do so no later than 48 hours after the day and time when the lesson was originally scheduled. Unjustified cancellations shall be deemed as late cancellations (see Art. V.). The teacher reserves the right to evaluate whether the arisen situation can be viewed as unforeseen or a late cancellation.
- No stress! The lesson which falls into the category of Unforeseen situations will be rescheduled at everyone’s earliest convenience. There is no monetary compensation for these untaught lessons. Should the student be unable to make up the missed / rescheduled lesson, they can ask somebody else to take their place.
V. CANCELLATIONS & RESCHEDULING
Early cancelling means that the lesson shall be cancelled and rescheduled on condition that either the student or the teacher received and confirmed such cancellation notice from the cancelling party more than 24 hours before the time when the scheduled lesson was expected to take place.
Late cancelling means that the lesson is considered a no-show and therefore deemed as taught (unless the reasons fall into the category of unforeseen situations) if either the student or the teacher received and confirmed such cancellation notice from the concerned party less than 24 hours before the time when the scheduled lesson was expected to take place, or they failed to inform of cancelling it altogether.
We all make mistakes and nobody is perfect! Should the teacher cancel the lesson late for whatever reason, they shall teach the next lesson (or a rescheduled lesson) free of charge.
VI. TERM AND TERMINATION
This agreement comes to an end if either Party ends it by giving a 7 (seven) days written (electronic mail) notice.
VII. PAYMENTS
The student(s) undertakes that they will pay the price of _____________ ______ ( ___________________________________________________________ ) per hour times the number of agreed on lessons taught once every ___________________________ and that they will do so within 15 calendar days of receiving the teacher’s invoice by means of a wireless bank transfer using TransferWise services (https://wise.com/). The student can also chose to pay by other means, but if they decide to do so (not advised), they (the student) will need to assume all costs associated with corresponding bank fees, which in most cases will be rather high.
Information about the teacher (account holder} and financial institution, which shall be entered when making a non-cash transfer, will be stated on the invoice that the student(s) will receive after the first set of lessons.
When sending the funds, the invoice number shall be entered into the comments section as follows: Invoice number: (corresponding invoice number), for example, Invoice number: 000085.
The teacher acknowledges that in most cases there are low bank fees when funds are being transferred via TransferWise. The teacher accepts and assumes these fees as his own expense on condition that the TransferWise is used to wire the funds.
VIII. SANCTIONS
There are no sanctions as such. If the student fails to pay for the lessons within the agreed time frame, the teacher shall kindly remind them to send the payment at their earliest convenience and shall suspend further lessons until the payment has been received by the teacher. Should the student fail to pay for the taught lessons after such reminder, the teacher reserves the right to terminate this agreement by writing a brief e-mail message to the student informing them of the decision.
If the teacher fails to teach the arranged and agreed on lessons, or in any way does not abide by the rules of this agreement, the student has the right to terminate this agreement by writing a brief e-mail message to the teacher informing them of their decision.
IX. MISCELLANEOUS
- This agreement enters into effect upon signing and remains in effect until full performance of the obligations by the parties.
- All notifications between the parties shall be forwarded to their electronic mail addresses as set out in this agreement.
- All changes and modifications to this agreement shall be made only with the mutual consent of the parties.
- All disputes and disagreements that may arise during or in relation to the performance of this agreement shall be settled by the parties through negotiations and amicably, where possible.
- This agreement is executed in two (2) originals, each of which shall be deemed an original and together shall constitute one and the same agreement, with one original being delivered to each party hereto.
